Former Red Hot Chili Peppers guitarist Josh Klinghoffer was sued after he fatally struck a pedestrian with his SUV. He is said to have been driving while distracted and did not see the person he killed. The deceased’s family has now filed a lawsuit against the musician for wrongful death and negligence.

YouTuber runs over pedestrians during livestream.

The lawsuit, written by the family’s attorney, says Klinghoffer was using his phone at the time of the crash. Footage of the crash shared by KTLA 5, which was interrupted before impact, shows the pedestrian apparently crossing the street in a crosswalk. Klinghoffer’s SUV turns left and heads right toward the pedestrian.

In addition, the family’s lawyer claims that he has evidence that Klinghoffer was on the phone at the time of the accident. He further explains that the musician got away with this violation solely because of his fame and financial influence.

Although the incident occurred in Alhambra, California, in March, it was kept out of the press until the lawsuit was recently filed. But now the genie is out of the bottle, and it’s unclear what consequences this might have in the future.

Klinghoffer is currently on tour with Pearl Jam.

The guitarist’s attorney gave a statement to KTLA 5 about the incident, calling it a “tragic accident.”

We don’t know what evidence the family’s attorney has, so we can’t even comment on this lawsuit. What we do know is that any accident that results in death is a tragedy, whether someone was negligent or not. We hope that no matter how the litigation turns out, the victim’s family can find a way to move on.

Distracted driving can have serious, sometimes fatal, consequences, which is why we’re big advocates of people putting their phones down, not fiddling with the infotainment screen, and just keep driving.
